Welcome to the website of Heritage Insurance Advisors ("HIA," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of this website and the forms, tools, and content made available through it (collectively, the "Site"). Please read these Terms carefully. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms apply only to the public Site. Insurance policies are governed by their own terms, and any client portal or other service we provide may be subject to additional terms presented when you use it. Nothing in these Terms modifies an insurance policy or any separate written agreement between you and HIA.

No Coverage Is Bound Through This Site

Submitting information through the Site is a request for a quote. It does not, by itself, constitute a completed application, binder, contract, or offer of insurance.

No coverage is bound, issued, changed, renewed, reinstated, or cancelled solely because information was submitted through the Site or sent to us by email, text message, or voicemail. Coverage is effective only when an authorized representative of HIA or the insurance carrier expressly confirms that it has been bound and states its effective date. An automated message only acknowledges receipt of your submission and does not confirm coverage.

Any premium figures or coverage descriptions provided in connection with a quote request are estimates based on the information available at the time. They are subject to carrier underwriting, eligibility, inspection, and rating requirements and may be changed or withdrawn before coverage is bound.

Time-Sensitive and Policy-Related Requests

Do not rely on the Site, its forms, email, text messages, or voicemail to bind, change, renew, reinstate, or cancel coverage; add or remove property, vehicles, or drivers; request certificates or evidence of insurance; report a claim; or satisfy any deadline or notice requirement. Contact HIA directly or use the contact information and procedures provided by your insurance carrier.

Information sent through the Site may be received and reviewed as an inquiry or quote request, but it will not be treated as notice to take any of the actions described above. If a matter is urgent or time-sensitive, speak directly with HIA or the carrier and obtain confirmation that the requested action has been completed.

Submitting information through the Site does not obligate HIA to procure insurance or create a fiduciary or advisory relationship. HIA assumes an obligation to procure or service coverage only when it expressly agrees to do so.

Accuracy and Authority

When you provide information through the Site, you represent that it is accurate and complete to the best of your knowledge and that you are authorized to provide it, including information concerning other members of your household or your business. Quotes, eligibility, underwriting, pricing, and coverage decisions depend on the information provided. Inaccurate, incomplete, or omitted information may affect a quote or a carrier's rights under an issued policy.

Informational Content

Content on the Site is provided for general informational purposes. It is not insurance advice for your particular circumstances and is not legal, tax, or financial advice. Descriptions of insurance products, coverages, and carriers are summaries only. The terms, conditions, limits, and exclusions of an issued insurance policy control in all cases. If Site content differs from the policy, the policy governs.

Licensing and Availability

HIA is an independent insurance agency based in Edmond, Oklahoma, and licensed in Oklahoma, Texas, and Kansas. Nothing on the Site is an offer or solicitation of insurance in a state or jurisdiction where HIA is not licensed or where the offer or solicitation would be unlawful. Products, carriers, coverages, and eligibility vary by state and applicant and may not be available in every location.

Third-Party Services and Links

The Site may include or link to tools, services, and websites operated by others. Your use of a third-party service is governed by that provider's own terms and privacy practices. HIA does not control and is not responsible for the content, availability, security, or practices of third-party services. The inclusion of a link does not, by itself, constitute an endorsement.

Acceptable Use

You may use the Site only for lawful purposes. You agree not to:

• submit false or misleading information or information concerning another person without authority;
• interfere with the operation or security of the Site or the systems that support it;
• use automated means to access the Site or collect content in violation of these Terms or attempt to bypass measures intended to prevent automated access;
• introduce malicious code or attempt to gain unauthorized access to any system, account, or data; or
• use the Site to harass or harm another person or violate applicable law.

We may restrict or terminate access to the Site and may decline to respond to a submission when we reasonably believe the Site has been misused or these Terms have been violated.

Intellectual Property

The Site and its content, including its text, graphics, logos, and design, are owned by HIA or its licensors and are protected by applicable intellectual-property laws. HIA grants you a limited, revocable, nonexclusive right to access the Site and to view, download, and print content for your personal, noncommercial use. All other rights are reserved. You may not use HIA's name, logo, or other protected content without prior written permission.

Disclaimer of Warranties

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, HIA disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and noninfringement. HIA does not warrant that the Site will always be available, uninterrupted, secure, or error-free or that all content will be complete, accurate, or current.

Limitation of Liability

To the fullest extent permitted by law, HIA and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, arising out of or relating to access to or use of the Site or the inability to use it, even if advised of the possibility of those damages.

This limitation applies only to claims arising from the Site. It does not limit obligations HIA may have under a separate written agreement, obligations of an insurance carrier under an issued policy, or liability that cannot lawfully be limited or excluded.

Indemnification

You agree to indemnify and hold harmless HIA and its owners, employees, and agents from third-party claims, damages, and reasonable expenses arising from your fraudulent or unlawful use of the Site, your infringement of another person's rights, or your submission of information concerning another person without authority. This provision does not apply to claims arising from ordinary use of the Site or a good-faith quote request.

Governing Law and Venue

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site must be brought in a state or federal court of competent jurisdiction located in Oklahoma County, Oklahoma, and each party consents to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Any changes apply prospectively from the effective date shown. We will provide any additional notice required by law.

Severability and Entire Agreement

If any provision of these Terms is held unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. These Terms and any additional terms presented for a particular Site tool or service constitute the entire agreement between you and HIA concerning use of the Site.
